Plain-English terms for the Hyperscales browser game (open beta).
1. Who we are
Hyperscales (hyperscales.app) is operated by
Polyák Csaba e.v., a Hungarian sole proprietor, brand Hyperscales,
registered at 4324 Kállósemjén, Kölcsey Ferenc út 11., Hungary. Tax number: 68747961-1-35.

2. What Hyperscales is
Hyperscales is a browser-based simulation game where you build a fictional hosting company and interact with AI-generated non-player characters. It is provided "as-is" during open beta. Features may change, break, or disappear without notice.
3. Who can play
- You must be at least 16 years old (or the GDPR digital-consent age in your country).
- You agree not to use the game for anything illegal under Hungarian or EU law.
- One human, one account. No bot accounts, no farming. We may rate-limit or close accounts at our discretion.
4. Your account
You're responsible for the security of your password. If you use cross-brand single sign-on (SSO) via PromNET, the same account terms apply. Tell us at [email protected] if you suspect unauthorized access.
5. AI-generated content
Customer messages, tickets, NPC dialogue and similar in-game text are generated by large language models (LLMs). They are fictional and may produce inaccurate, weird, or offensive output. We don't endorse it. If you see something that crosses a line (illegal content, harassment, CSAM-adjacent material), report it to [email protected].
You can plug in your own LLM API key. In that case the LLM provider's terms apply to those calls — we just forward them.
6. User-generated content
Names, company titles, public profile text and any other content you submit must not be illegal, defamatory, sexual content involving minors, or copyrighted material you don't own. We may remove content and/or close accounts that violate this without notice.
You retain ownership of what you create. You grant us a worldwide, royalty-free license to host, display and process it as needed to run the game.
7. Payments
The game is free during open beta. We may add paid plans later — separate terms and a cancellation flow will apply, and we'll notify you in advance. You are not auto-enrolled into anything paid.
8. Service availability
We aim for high uptime but make no SLA during beta. We may schedule maintenance, throttle abusive traffic, or shut down regions without prior notice. Your save data is stored in Cloudflare D1 (EU region by default) and is best-effort durable, not guaranteed.
9. Termination
You can stop playing and ask us to delete your account anytime — email [email protected] with the subject "delete my account". We respond within 30 days. We may suspend or terminate accounts that abuse the service, violate these terms, or threaten the safety of other users.
10. Liability
To the maximum extent allowed by Hungarian and EU law, Hyperscales is provided without warranty of any kind. We are not liable for lost gameplay progress, lost revenue from third-party LLM costs, or other indirect damages. Mandatory consumer-protection rules under Hungarian law (e.g. for natural persons acting as consumers) are not affected.
11. Changes
We may update these terms. Material changes will be announced in the app and reflected by a new "Last updated" date below. Continued play after a change means you accept the new version. If you don't, stop playing and ask us to delete your account.
12. Disputes & governing law
These terms are governed by the laws of Hungary. Disputes go to the competent Hungarian court at our registered seat. EU consumers may also use the European Commission's Online Dispute Resolution platform. Consumers in Hungary may contact the local Conciliation Body (Békéltető Testület).
